WEAVING THE RED THREAD'S TERMS & CONDITIONS

These terms and conditions (the “Terms and Conditions”) govern the use of www.weavingtheredthread.com.au (the “Site”). This Site is owned and operated by Weaving the Red Thread, Naturopathic Womancraft and My Rhythmic Being, referred to in this document as Weaving the Red Thread and directors.  

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

Intellectual Property

All content published and made available on our Site is the property of Weaving the Red Thread and the Site’s creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

Accounts

When you create an account on our Site, you agree to the following:

  1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and

  2. All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.

We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.

Sale of Goods

These Terms and Conditions govern the sale of goods available on our Site.

  • Studio Membership

  • Live class streaming

  • Products

These Terms and Conditions apply to all the goods that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods we provide. You agree to purchase goods from our Site at your own risk.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Medical Advice Disclaimer - The information, including not limited to: videos, audios, text, graphics, images and other materials contained in the Online Menstruality Wellbeing Studio, are for informational purposes only. No material in this Studio is intended to be a substitute for professional medical advice, diagnosis or treatment. Always seek the advice of your physician or other qualified healthcare provider with any questions you may have regarding a medical condition or treatment, and before undertaking a new health care regimen. Never disregard professional medical advice or delay in seeking it because of something you have experienced, heard or read in the Studio. 

 

Privacy and Confidentiality - While participating in the Studio, all participants agree to respect everybody's confidentiality to ensure that this is a safe environment for all participants. Therefore, Weaving requests that you do not repeat or refer to anything anyone says or shares within the Studio Community, including on social media pictures/comments or general conversation. You are very welcome to share you own experience. 


Live Weekly Weaver's Circle - please note that the Studio's weekly weaver's circles are held only during the NSW School Terms. As mothers we honour our rhythmical family self care and nourishment, by being completely present with our children and families during the holiday periods. During the longer Christmas Break the Live Solstice Immersion and 1 weekly weaver's circle will be held during January.


Cancellation Policy - As a trial member it is your responsibility to cancel your free trial membership before payment begins. The membership is a monthly fee. You can cancel your membership at any time which will cancel the next billing cycle.  


Copyright Policy - All the content: videos, audios, lives, text, graphics, images, documents, downloadable files and other materials contained within the Online Menstruality Wellbeing Studio are protected under copyright law. Thank you for honouring this.  

By purchasing a free trial and or membership, each time you log into the Studio or access the Studio Community you are accepting and agreeing to these requirements - medical disclaimer, privacy & confidentiality, terms & conditions and copyright - as a condition of your participation. Payments

We accept the following payment methods on our Site:

Storage of Personal & Credit Card Information

All personal & credit card information is stored within either Stripe or paypal, secure services used to store and manage your information.  Stripe is a PCI (Payment Card Industry) Level 1 Compliant services that have their own privacy policies which will apply to any information that you provide. When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument. 

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction. 

Consumer Protection Law

Where the Australian Consumer Law, Schedule 2 of the Competition and Consumer Act 2010, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Limitation of Liability

Weaving the Red Thread and our directors, officers, agents, contractors, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site. 

Indemnity

Except where prohibited by law, by using this Site you indemnify and hold harmless Weaving the Red Thread and our directors, officers, agents, employees, contractors, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions. 

Applicable Law

These Terms and Conditions are governed by the laws of the State of New South Wales.

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid. 

Changes

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.

Assumption of Risk and Release of Liability AT

This Site is owned and operated by Weaving the Red Thread, Naturopathic Womancraft and My Rhythmic Being, referred to in this document as Weaving the Red Thread and Directors. 

I hereby acknowledge and agree:

The purpose of Weaving the Red Thread and Directors goods and services is to improve the overall health, vitality and well-being through education and the use of education, wellbeing practices, diet and lifestyle recommendations and non-medicinal nutritional and herbal supplementation. Weaving the Red Thread and Directors does not diagnose diseases, disorders or conditions.

Weaving the Red Thread and Directors are not a licensed Dietitian, Doctor or Medical Physician.

As part of the Menstruality Wellbeing Studio Services, I may be asked to provide information concerning my physical habits, medical history, moods, energy levels, likes and dislikes, lifestyle and diet. This information is collected to enable the Weaving the Red Thread and Directors to: (i) assess my knowledge of my health and wellness, (ii) educate  me about the benefits of sound wellbeing and naturopathic practices and (iii) recommend general Menstruality Wellbeing Practices, lifestyle and dietary changes to improve my general health, vitality and overall well-being. Weaving the Red Thread and Directors will hold this information in confidence and will not release or disclose this information to any other person, without my prior consent, except as required by applicable law.

If the Weaving the Red Thread and Directors suspect the existence of disease, disorder or condition, I will be informed of this suspicion. However, I acknowledge this is not a diagnosis or conclusion about the state of my health and that I am directed to promptly consult a medical General practitioner about any suspected problems.

Should I request the Weaving the Red Thread and Directors, to recommend Menstruality Wellbeing Practices, dietary changes and/or nutritional supplements to enhance my body’s natural ability to resist and/or overcome a known disease, disorder or condition, it is my responsibility to disclose the nature of the disease, disorder or condition and all other relevant details to the Weaving the Red Thread and directors. If I have not previously consulted a medical practitioner (GP) or specialist about this disease, disorder or condition, I acknowledge that I am directed to promptly do so. I am not to alter or discontinue treatments prescribed by a medical practitioner (GP or specialist) or other licensed health professional without consulting the individual who prescribed the treatment.

In providing Menstruality Wellbeing Practices and Services to me, the Weaving the Red Thread and Directors, is relying upon the truth, accuracy and completeness of all information I have provided to them. Any recommendations I follow for holistic lifestyle changes including the use of herbal and nutritional supplements, are entirely my responsibility.

Weaving the Red Thread and Directors is in no way liable for my holistic health or safety.

In consideration of my participation in  the services of Weaving the Red Thread and Directors, I hereby accept all risk to my holistic health, including injury or death that may result from such participation and I hereby release the Weaving the Red Thread and Directors, on my behalf and on behalf of my personal representatives, estate, heirs, next of kin, and assigns from any and all costs, claims, causes of action and damages arising from any and all illness or injury to my person, including my death, that may result from or occur as a result of my participation in consultation and support from Weaving the Red Thread and directors, whether caused by negligence or otherwise.

Weaving the Red Thread and Directors Cancellation Policy

Consults:  48 hours is required for cancelling booked appointments, after that you will receive a 50% refund.

Memberships: Memberships can be cancelled at any time prior to your upcoming billing date.  

Workshops: No refunds offered. Cancellations only due to COVID or family emergencies will be offered a makeup workshop inperson or online, valid only for 12mths.

Programs: No refund on programs. 

COVID Specific information: In the advent of a Covid Lockdown or Event alternative dates will be offered.

I understand that any therapies I undertake at Weaving the Red Thread and Directors, are undertaken of my own free will. I accept that the ultimate responsibility for my health care is my own and that Weaving the Red Thread and Directors are here to support me in this. 

I understand that my facilitator/practitioner reserves the right to determine which cases fall outside their scope of practice, in which event an appropriate referral will be recommended. I hereby agree to assume full responsibility for any manner of loss, injury, claim or damage whatsoever, known or unknown, incurred as a result of same and I, my heirs, executors, administrators or assigns for any loss, injury, claim or damage sustained as a result of my attendance and/or participation. I have read the above release and waiver of liability, and fully understand its contents and voluntarily agree to the terms and conditions stated.

I HAVE CAREFULLY READ THIS AGREEMENT AND AGREE TO THE TERMS OUTLINED ABOVE. I UNDERSTAND THIS AGREEMENT TO BE A FULL AND FINAL RELEASE OF ALL COSTS, CLAIMS, CAUSES OF ACTION AND DAMAGES OF ANY KIND ARISING FROM OR IN CONNECTION WITH THE Weaving the Red Thread and directors SERVICES.
